What qualifies as a material change of circumstance? A modification may be warranted for several reasons, including but not limited to:

  • The other party is not complying with the court-ordered custody or visitation arrangement (contemptuous behavior)
  • One parent has remarried, introducing new dynamics into the child's daily life
  • A significant move or relocation that impacts the current arrangement
  • A change in employment that affects a parent’s availability or financial stability
  • A combination of multiple smaller changes that, together, alter the child’s environment or needs
